**SOLE RESPONSIBILITY OF BUYER:** It is your sole and exclusive responsibility to:

IF A PRODUCT IS NOT AS DESCRIBED, YOUR SOLE REMEDY IS TO RETURN IT IN ACCORDANCE WITH OUR REFUND & RETURN POLICY (SECTION 7) AND RECEIVE A REFUND. THE COMPANY SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES RESULTING FROM PRODUCT USE OR FAILURE.

  1. PRICING & PAYMENT

    1. Currency & Price Changes

All prices are listed in United States Dollars (USD). We reserve the right to change prices at any time without notice. Prices shown at the time you place an order are the prices in effect for that order, provided no pricing errors are corrected pursuant to Section 5.2 below.

 

  1. Pricing Errors

We reserve the right to correct any obvious pricing errors (including errors made by third-party payment processors) at any time before or after order confirmation. If we identify a pricing error after your payment has been processed, we will notify you and either: (a) correct the error and adjust the charge accordingly; or (b) cancel the order and issue a full refund.

 

  1. Accepted Payment Methods

We accept the payment methods displayed on our website at checkout. By submitting payment information, you represent and warrant that:

Receipt of an order confirmation email does NOT constitute our acceptance of your order. We reserve the right to refuse, limit, or cancel any order for any reason, including but not limited to:

  2. Pricing or product description errors

  3. Reasonable evidence of fraudulent activity

  4. Regulatory compliance concerns

  1. Our Right to Cancel Orders

If we cancel your order after payment has been processed, we will notify you by email and issue a full refund to your original payment method within fourteen (14) business days.

 

  1. Your Right to Cancel Orders

You may cancel an order within twenty-four (24) hours of placing it by emailing coleladdersafety@gmail.com with your order number. Include the reason for cancellation in your email.

 

**Cancellation Limitations:** If your order has already been processed for shipment or has been shipped, you cannot cancel it. However, you may refuse delivery (see Section 7 – Shipping & Delivery).

 

  1. Refund Processing

Approved refunds will be credited to your original payment method within fourteen (14) business days of our receipt and inspection of the returned item. Please allow additional time for your financial institution to post the credit.

 

  1. Order Processing Timeframe

Orders are processed within 1–2 business days of payment confirmation (Monday–Friday, excluding federal holidays). You will receive a shipping confirmation email with tracking information once your order has shipped.

  1. SHIPPING & DELIVERY

    1. Shipping Policies

Shipping costs are calculated at checkout based on your location, order weight, and selected carrier. Shipping fees are non-refundable except in cases where we cancel an order or you refuse delivery due to our error.

 

  1. Shipping Locations

Cole Fire Supply ships to the continental United States only. Some hazardous materials, propellants, and regulated fire safety products cannot be shipped to certain states or regions due to federal and state regulations. We will indicate shipping restrictions at checkout. It is your responsibility to verify that your location can receive your desired products.

 

  1. Risk of Loss & Delivery

Risk of loss and title to products transfer to you upon delivery to the carrier. Once your order is transferred to the shipping carrier, you become responsible for any loss or damage during transit, except as provided in Section 7.4 below.

 

  1. Damaged or Lost Shipments

If your shipment is damaged in transit, you must:

  1. Refuse delivery or note visible damage on the shipping label;

  2. Report damage to Cole Fire Supply within five (5) business days with photographs of the damaged packaging and product;

  3. Contact your carrier to file a damage claim.

 

Upon verification of damage, we will, at our option, either replace the item or issue a full refund. For lost shipments, you must file a claim with the shipping carrier. Contact us for assistance with carrier claims.

 

  1. Delivery Timeframes

Delivery time-frames provided at checkout are estimates only and are not guaranteed. Cole Fire Supply is not responsible for delays caused by:

  1. Carrier delays or scheduling

  2. Inclement weather or natural disasters

  3. Customs or regulatory delays (if applicable)

  4. Any circumstances beyond our reasonable control

 

We will provide a tracking number upon shipment. You are responsible for monitoring tracking and ensuring someone is available to receive delivery.

 

  1.  DISCLAIMER OF WARRANTIES

These products are tools only. Their effectiveness depends entirely upon:

The absence of a fire suppression system or the failure of such a system may result in property damage, serious injury, or death.

 

  1. LIMITATION OF LIABILITY

EXCEPT AS PROHIBITED BY CALIFORNIA LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM YOUR USE OF THIS WEBSITE OR YOUR PURCHASE AND USE OF ANY PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE APPLICABLE ORDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

These limitations apply even if Cole Fire Supply has been advised of the possibility of such damages.

 

  1. Exceptions to Limitation of Liability

**NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR:**

These Terms & Conditions are governed by the laws of the State of California, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

 

  1. Jurisdiction & Venue

You agree that any dispute arising out of or related to these Terms, the website, or any purchase shall be resolved in Placer County, California, in accordance with California law.

 

  1. Binding Arbitration

**ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE WEBSITE, OR YOUR PURCHASE OF PRODUCTS SHALL BE RESOLVED BY BINDING ARBITRATION, NOT IN COURT, EXCEPT AS PROVIDED IN SECTION 13.4.**

 

  1. Arbitration Procedures

Disputes shall be submitted to binding arbitration under the Comprehensive Arbitration and Mediation Services (CAMS) rules administered by the American Arbitration Association (AAA). The arbitration shall be conducted as follows:

  1. **Pre-Arbitration:** Before initiating arbitration, you and Cole Fire Supply agree to attempt good-faith negotiation to resolve the dispute for thirty (30) days.

  2. **Arbitrator Selection:** One neutral arbitrator shall be selected in accordance with AAA rules.

  3. **Location:** Arbitration proceedings shall be conducted in Placer County, California, or by videoconference at the arbitrator's discretion.

  4. **Rules:** The arbitration shall be governed by the AAA's Consumer Arbitration Rules in effect at the time the claim is filed.

  5. **Fees & Costs:** 

  1. Cole Fire Supply shall pay all AAA filing fees and arbitrator fees that exceed the amount you would pay to file a claim in court

  2. Each party shall bear its own attorney's fees and costs, unless otherwise provided by law

  3. This allocation ensures arbitration does not impose costs on consumers that would prevent access to arbitration

  1. **Relief:** The arbitrator shall issue a written decision and award. The arbitrator has the power to award any relief available under applicable law.

 

  1. Exception – Small Claims Court

Notwithstanding the arbitration agreement, you may pursue a claim in small claims court if the claim qualifies and remains within small claims jurisdiction.

 

  1. Class Action Waiver

YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST COLE FIRE SUPPLY ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

 

  1. CHANGES TO THESE TERMS

Cole Fire Supply reserves the right to update, modify, or amend these Terms & Conditions at any time. Material changes will be effective upon posting to this website, with notice provided via email or prominent website notice.

  1. FORCE MAJEURE

Cole Fire Supply is not liable for any failure or delay in performing any obligation under these Terms if such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God (earthquake, flood, fire, hurricane, tsunami), natural disasters, pandemics, epidemics, government actions or restrictions, war, terrorism, strikes, labor disputes, embargoes, or other force majeure events.

 

In the event of a force majeure occurrence that prevents Cole Fire Supply from performing its obligations, we will:

  1. Notify you of the delay or inability to perform within 5 business days; 

  2. Use reasonable, good-faith efforts to resume performance as soon as reasonably practicable; 

  3. Not be liable for damages, delays, or losses resulting from the force majeure event.

If a force majeure event prevents performance for more than thirty (30) consecutive days, you may cancel any affected orders and receive a full refund to your original payment method. Cole Fire Supply will not be liable for any additional damages or claims.

This provision does not excuse payment obligations for products already shipped and delivered.

 

  1. ENTIRE AGREEMENT

These Terms & Conditions, together with any Privacy Policy and Return & Refund Policy published on our website, constitute the entire agreement between you and Cole Fire Supply regarding your use of the website and purchase of products. These Terms supersede all prior understandings, agreements, and negotiations, whether written or oral.

 

  1. WAIVER & INDEMNIFICATION

    1. Waiver

No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorized representative of Cole Fire Supply. Our failure to enforce any right shall not constitute a waiver of that right.
